“I am thinking about getting a divorce, what should I do?” There are a lot of things to consider when you have a divorce. You have been married with somebody for a number of years. Maybe you own a home. Maybe you have children. You certainly have acquired vehicles. You certainly have acquired furniture. You may have play toys like motorhomes and ATVs and boats and things like that. You each may have a retirement account. There may be children from previous relationships. So you have to think about “what steps do I need to take to cleanly and effectively end this marriage if that is what I want to do; or if that is what my spouse wants to do.”

Nevada is a “No Fault State” Nevada basically is a no fault divorce state. Back in the 1940s and 1950s it wasn’t easy to get a divorce in the United States. You had to prove fault. You had to prove there was a reason why you were entitled to a divorce.

Those would be some of the basis you could go in and get a divorce in the old days.

Now a days, if one party wants to get divorced, you are getting divorced; that’s all there is to it! It’s a no fault divorce, which means if one party wants to get divorced, you are getting divorced!

So what should I do if I want to get divorced, or I find out my spouse is getting ready to divorce me?

The first thing you should do is consult with an attorney who practices in the area of family law. As stated before, there is a lot of issues to consider. Not only assets, income, spousal support, child support, child custody, division of assets, and ongoing liabilities. People that go into court and try and represent themselves have no idea that they could be putting themselves inline for financial obligation to payoff credit cards, to pay child support, to pay other debts, to pay spousal support for years and years and years that they may not have found themselves liable for had the retained competent council to assist them through the process.

So if you are thinking about getting a divorce, you need to have a free consultation with a competent divorce and family law attorney. That attorney will sit down with you and find out the answer to all these questions about the extent of your assets and obligations, the health of the parties involved, and the children. Once that’s all been determined, that attorney can sit down with you and tell you (under the current state of the law) what the court is likely to do if you go to a contested divorce.
